Pharmaceutical giant Merck is suing the federal government, claiming that this health policy change is unconstitutional. Merck claims the change will reduce the company’s revenue and hinder its ability to invent new therapeutics.
In the complaint, Merck argued that Medicare drug price negotiations, which will go into effect in 2026, are “tantamount to extortion.” Merck is arguing that forcing drugs to be sold at prices set by the government violates a clause of the Fifth Amendment that prohibits the government from taking private property without just compensation.

The LIV Golf Tour is supported by billions of dollars from Saudi Arabia’s sovereign wealth fund, and attracted many golfers away from the PGA Tour with larger payouts. LIV sued the PGA Tour last year, claiming the PGA used its monopoly power to prevent media companies and vendors from working with LIV. The PGA Tour countersued, alleging that LIV interfered with its players’ contracts.
